proviso mid-15c., from M.L. proviso (quod) "provided (that)," phrase at the beginning of clauses in legal documents (mid-14c.), from L. proviso "it being provided," ablative neut. of provisus, pp. of providere (see PROVIDE (Cf. provide)).
